Article 2

Reproduction right

Member States shall provide for the exclusive right to authorise or prohibit direct or indirect, temporary or permanent reproduction by any means and in any form, in whole or in part:

(a) for authors, of their works;

(b) for performers, of fixations of their performances;

(c) for phonogram producers, of their phonograms;

(d) for the producers of the first fixations of films, in respect of the original and copies of their films;

(e) for broadcasting organisations, of fixations of their broadcasts, whether those broadcasts are transmitted by wire or over the air, including by cable or satellite.

제2조

복제권

회원국은 직접적이든 간접적이든, 임시적이든 영구적이든 전체 혹은 일부를 어떤 형식으로든, 다음 각호의 구분에 따라, 복제할 배타적 권리를 부여한다.

(a) 저작자에게, 그 저작물에 있어서

Article 3

Right of communication to the public of works and right of making available to the public other subject-matter

1. Member States shall provide authors with the exclusive right to authorise or prohibit any communication to the public of their works, by wire or wireless means, including the making available to the public of their works in such a way that members of the public may access them from a place and at a time individually chosen by them.

2. Member States shall provide for the exclusive right to authorise or prohibit the making available to the public, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them:

(a) for performers, of fixations of their performances;

(b) for phonogram producers, of their phonograms;

(c) for the producers of the first fixations of films, of the original and copies of their films;

(d) for broadcasting organisations, of fixations of their broadcasts, whether these broadcasts are transmitted by wire or over the air, including by cable or satellite.

3. The rights referred to in paragraphs 1 and 2 shall not be exhausted by any act of communication to the public or making available to the public as set out in this Article.

제3조

저작물의 공중에의 통신권과 다른 문제에 관하여 공중에게 이용하게 할 권리

Article 4

Distribution right

1. Member States shall provide for authors, in respect of the original of their works or of copies thereof, the exclusive right to authorise or prohibit any form of distribution to the public by sale or otherwise.

2. The distribution right shall not be exhausted within the Community in respect of the original or copies of the work, except where the first sale or other transfer of ownership in the Community of that object is made by the rightholder or with his consent.

제4조

배포권

1. 회원국은 저작자에게 그 저작물의 원본 및 사본에 관하여, 공중에게 판매 기타 방법으로 어떤 형식으로든 배포하는 것을 허용하거나 금지할 배타권 권리를 부여하여야 한다.

2. 배포권은 저작물의 원본이나 사본에 관하여, "공동체" 내에서 소진되지 아니한다. 다만, 그러한 객체가 "공동체" 내에서 최초 판매되거나 기타 양도되는 것이 권리자나 그의 동의를 얻은 경우를 제외한다.

일시적인 복제는 일정한 경우 저작권의 침해로부터 면제되는데, 면제되기 위하여서는 임시적 복제행위가 일시적 또는 부수적이며 기술적 과정에서 불가결하거나 필수적인 부분이며 오직 유일한 목적으로 (1) 네트워크에서 중간매개자가 제3자간의 통신을 가능하게 하거나, (2) 저작물이나 다른 대상을 합법적으로 사용할 수 있도록 하는 것이어야 하며, 독립적인 경제적 중요성을 가지지 않아야 한다.(제5조) 영구적 복제권(제2조)에 대해서는 회원국에서 다음의 경우 예외 또는 제한을 규정할 수 있다: (1) 저작권자가 공정한 보상을 받는 것을 조건으로 하여, 사진기술이나 이와 유사한 효과를 가지는 방법에 의하여, 종이나 이와 유사한 매체에 복제하는 경우,
